MJ Otto Lawn Care, LLC

An Iowa Limited Liability Company

Effective Date: March 1st, 2026

1. Services Provided

MJ Otto Lawn Care, LLC (“Company”) provides residential lawn maintenance services including:

Lawn mowing
Edging
String trimming
Seasonal lawn cleanups and debris removal (when agreed to in writing)

No other services are included unless expressly agreed to in writing.

2. Scheduling & Weather

Services are performed on a scheduled route basis, generally the same day each week.
Service days may change due to weather, holidays, equipment issues, or operational needs.
In the event of inclement weather, services will be rescheduled to the next available service day.
Skipping scheduled service is not permitted unless approved by the Company.

3. Property Access & Customer Responsibilities

Customers agree to:

Ensure gates are unlocked and accessible on the scheduled service day.
Secure pets prior to service.
Remove toys, hoses, lawn décor, and other obstacles from mowing areas.
Clearly mark sprinkler heads, invisible fences, landscape lighting, drainage systems, and other ground-level fixtures.

The Company is not responsible for damage to unmarked, concealed, or improperly installed items.

If service cannot be completed due to restricted access, unsecured pets, or obstructed areas, the service may be rescheduled and a trip charge may apply.

4. Cleanup Services

Seasonal cleanups include removal of leaves, grass clippings, and natural yard debris.

The Company is not responsible for:

Damage to hidden or buried items.
Damage to fragile landscape features.
Pre-existing property conditions.
Debris-related damage caused by objects left on the property.

Customers must report any service-related concerns within forty-eight (48) hours of service completion.

5. Insurance & Liability

MJ Otto Lawn Care, LLC maintains general liability insurance.

Liability for any verified damage caused directly by the Company is limited to the cost of the service provided.

Under no circumstances shall the Company be liable for incidental, indirect, or consequential damages.

6. Payment Terms

Payment is due within seven (7) days of the invoice date (Net 7).
Late payments may incur fees consistent with Iowa industry standards.
Services may be suspended for unpaid balances.
Customers are responsible for any returned or failed payment fees.
All services are subject to applicable Iowa sales tax.

Accepted payment methods include credit/debit cards, ACH, check, and approved digital payments.

7. Cancellation Policy

Customers may cancel service with at least seven (7) days’ written notice.

Customers enrolled through a promotional door-hanger offer agree to a minimum commitment of eight (8) consecutive weeks. Early cancellation during this period may result in a charge equal to the remaining promotional balance.

8. Communication Policy

All service-related communication must be directed through the Company’s official business phone number or designated business email.

The Company does not conduct business through personal phone numbers, personal text messages, or social media messaging.

9. Governing Law

These Terms shall be governed by the laws of the State of Iowa. Any legal action shall be brought in the appropriate courts within the State of Iowa.

10. Acceptance of Terms

By accepting service, the Customer acknowledges and agrees to these Terms of Service.
